TERMS OF SERVICE
IMPORTANT: BY USING THE KANBANA SERVICE YOU AGREE TO BE BOUND BY THESE TERMS OF SERVICE. PLEASE REVIEW THESE TERMS OF SERVICE CAREFULLY BEFORE USING OUR SERVICE. IF YOU DO NOT AGREE TO THESE TERMS OF SERVICE YOU DO NOT HAVE THE RIGHT TO ACCESS OR USE OUR SERVICE.
1. Terms of Service
These Terms of Service (“Terms of Service”) constitute a contract between Homestake Digital LLC (“Homestake Digital”) and you. By using the “Service”, you acknowledge, accept and agree with all provisions of the “Terms of Service” and our “Privacy Policy”.
2. Service Definition
The “Service,” “Kanbana Service”, or “Kanbana” is an application designed to help people manage their personal to-do list, or any list of items that need to be completed.
3. Account Obligations
By creating an Account you agree to the following:
You must provide true, accurate, current and complete information about yourself as prompted by the registration form, and maintain and promptly update the registration data to keep it true, accurate, current and complete. We assume no duty to verify such information. If you provide any information that is untrue, inaccurate, not current or incomplete we have the right to suspend or terminate your account.
You are responsible for protecting the password and for all activities that occur under your account. You should notify us immediately if you become aware of any breach of security or unauthorized use of your account.
The Service is not intended for use by persons under the age of 13. By using the Service you are representing to us that you are over the age of 13.
4. Pricing Plans
4.1. Kanbana Basic
Kanbana Basic is free of charge to use across mobile and desktop devices; however, Kanbana Basic users are limited to using one board and no more than 20 task cards.
When you create an account (an “Account”) we store your data remotely so you can access Kanbana Basic across devices, including our mobile applications, web application and desktop applications.
4.2. Kanbana Premium
Kanbana Premium is an extension of Kanbana Basic and gives you the following additional capabilities:
Kanbana Premium users can create an unlimited number of task cards.
Kanbana Premium users can create an unlimited number of boards.
Kanbana Premium is a paid service and will be charged either annually or through a monthly subscription.
4.3 Promotional Offers Converting to Kanbana Premium Subscriptions.
You may be offered a promotional offer in connection with a Kanbana Premium service, such as a trial period or initial discount (each a “Promotional Offer”).
5. Billing and Questions
5.1. Subscription
Kanbana Premium is an annual or monthly subscription and will be charged either (a) through your Apple iTunes or Google Play account if you subscribe through the mobile application, (b) through Fastspring, Stripe or other payment provider if you subscribe through the Windows, Mac, or web-based application, or through (c) a third party provider that may provide a license key to access your subscription.
Your subscription will automatically renew unless canceled before the end of the current period as outlined by the payment provider referenced in clauses (a), (b) and (c) of the prior paragraph.
You will not be able to cancel the subscription period once activated after any trial period has concluded.
Subscriptions (including auto-renewal settings) may be managed by the user through your Apple iTunes or Google Play account in the case of clause (a) of the first paragraph of this section, through your My Account in our web application in the case of clause (b) of the first paragraph of this section, and either My Account or through the third party provider in the case of clause (c) of the first paragraph of this section.
5.2. Questions
Any additional questions regarding your subscription or billing can be sent to Homestake Digital LLC via support@Kanbana.com.
6. Proper Use
You agree not to take any action that imposes an unreasonable load on our infrastructure; or copy, reproduce, alter, modify, or publicly display any information displayed on the Service (except for Your User Content), or create derivative works from our mobile application(s), desktop applications, or website (other than from Your User Content), to the extent that such action(s) would constitute copyright infringement or otherwise violate the intellectual property rights of Homestake Digital or any other third party, except with the prior consent of Homestake Digital.
You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service, use of the Service, or access to the Service without the explicit permission of Homestake Digital.
You agree not to access the Service by any means other than through the interfaces that are provided by Homestake Digital for use in accessing the Service.
7. Proprietary/Intellectual Property Rights
Homestake Digital and/or its third party suppliers retain ownership of all proprietary rights in the Service and in all trade names, trademarks and service marks associated or displayed with the Service. You will not deface, obscure or remove any of Homestake Digital or its suppliers' copyright or trademark notices associated with the Service. You may not reverse engineer or otherwise reduce to human readable form any software associated with the Service.
8. Communications
You understand and agree that the Service may include certain communications from Kanbana, such as service announcements, administrative messages, marketing messages, legal notices, etc., and that these communications are considered part of the Service. You have the ability to unsubscribe from promotional marketing communications at any time. You can unsubscribe from our emails by clicking the unsubscribe button. If you opt out, we may still send you non-promotional emails, such as those about your account or our ongoing business relations.
9. User Content
You retain ownership of your content, but by providing it to the Service, you are granting us a license to use, copy, reproduce, process, adapt, publish, transmit, host and display that content for the purpose of providing you the Service, providing customer support and improving the operation of the Service.
You understand that you are entirely responsible for all content that you provide and make available via your Account. Homestake Digital does not control the user content posted via the Service and, as such, does not guarantee the accuracy, integrity or quality of such content.
You shall not exploit, sell, license or rent any contents for commercial use or in any way that violates any third party right.
10. Termination
You may stop using the Service at any time. To delete your account and data, you can elect to do so from by logging into your account and clicking Delete My Account under the My Account tab.
Additionally, we reserve the right to suspend or end your Service at any time in our sole discretion and without notice. This includes the right to suspend or terminate your use of the Service if you don't comply with these Terms of Service, or if you use the Service in a way that would cause Homestake Digital any legal liability, disrupt the Service or negatively affect others' use of the Service.
In the event of suspension or termination, your Account will be disabled and you may not be granted access to your Account or content from your Account, and if necessary Homestake Digital may delete your user content.
11. Changes to Terms of Service
These Terms may be revised from time to time, but the latest version will always be available on our website. You agree to be bound by the revised Terms of Service by continuing to use or access the Services after the revisions come into effect.
